1. Payment

Deposit: £350 per person is payable immediatelyto secure your reservation. 2nd Payment: 50% of the outstanding balance ispayable 90 days before departure.Balance: payable 45 days prior to departure. Jon Baines Tours Ltd reserves the right to refuse to carry any personwho, in its opinion, is unfit to travel.

ATOL IS YOUR GUARANTEE THAT YOUR MONEY IS SAFE. Jon Baines Tours air holidays and flights are ATOL Protected, since wehold an Air Travel Organiser's Licence granted by the Civil AviationAuthority. Our ATOL number is ATOL 3800. In the unlikely event ofour insolvency, the CAA will ensure that you are not stranded abroadand will arrange to refund any money you have paid to us for anadvance booking. 2. Cancellation - Please read carefully

If, for any reason, you wish to cancel your reservation,written notification of intention should be sent to Jon Baines Tours Ltd. Cancellations are effective on the day theyare received by us. Please let us know the reason forcancellation. Please note that under NO circumstances will cancellation by telephone be acceptable.

The following cancellation charges would come into effectif written notification is received:More than 61 days before departure Deposit only Between 60 and 31 days before departure 60% of total30 days or less before departure 100% of totalThere is a required minimum number of persons travellingon our trips. In the event of the number falling belowthis requirement, Jon Baines Tours Ltd may be forced intocancellation of the tour and notification made 28 days priorto the date the tour is due to commence. In such cases wewill offer an alternative tour or refund all payments.

If outside circumstances beyond our control, e.g. war, natural disasters, etc., oblige us to withdraw the tour at anytime before or after the balance of payments is received,we shall offer an alternative tour. If none is acceptable oravailable, we will refund all money paid except the depositwhich will be used to defray administrative costs. In allcases any liability we may be under shall be limited to theamount of the refund.

3. Changes to costs

The costs quoted for our tours are based upon known costs andexchange rates prevailing at the time. We reserve the right to adjustthe cost of a trip should the value of the pound alter substantially, or ifairline rates are affected by fuel increases or services be subject to anincrease in dues, taxes or fees. Jon Baines Tours guarantees to absorbthe first 2% of any increase in price. Should a substantial change(e.g. more than 2% of the total cost) take place we will forward anamended invoice showing the adjustment no later than 30 days priorto departure. Should we be forced to increase the cost of the visit bymore than 10% of the total cost we will, if you wish, cancel your place,guarantee to return all monies paid provided we are notified withinseven days of the date shown on the amended invoice.

4 If we have to make a major change to your tour

If, before you depart, we have to make a major change to your tourarrangements e.g. a change of airport (but excluding aircraft type),hotel or date of departure, it will only be because we are forced to doso by circumstances usually beyond our control. In such an unlikelyevent we will inform you immediately and our objective will be tominimise your inconvenience. We will wherever possible offer youalternative arrangements as close as possible to your original choice.They may be of a superior value. In the unlikely event that they areof inferior value (e.g. if only lower grade hotels are available) we willrefund the difference in tour price. You will then have the choice ofaccepting, taking another available tour of similar price or cancelling. Should you wish to cancel, no other compensation will be payableand you will be reimbursed all monies paid to us.

5. Liability/Conditions of carriage

Any flights forming part of the tourarrangements will be subject to the conditions of carriage of theairline concerned. These conditions in most cases limit the airline'sliability to the customer in accordance with international law. OUR LIABILITY TO OUR CLIENTS We do not accept responsibilityfor death or bodily injury to our clients unless caused by the provennegligent acts or omissions of our Employees, Agents, Suppliers orSub-Contractors while acting within the scope of or in the course oftheir employment other than any services performed by air and seacarriers. Any such negligence must be proven under English Law inan English Court for any part of the arrangements for your tour asdescribed in the brochure or any excursions arranged by us.It is a condition of the above that you notify us immediately on yourreturn from the tour of any claim for Personal Injury.

RESPONSIBILITY TO OUR CLIENTS If any part of the arrangementsbooked with us is not provided in the advertised manner we willpay you appropriate compensation if this has affected your travelarrangements. We cannot accept responsibility for reasons of war,riots, terrorist activity, government intervention, civil strife, industrialdisputes, natural disasters, disease, mechanical or constructuraldifficulties or technical transport problems and changes due to reasonsbeyond our control. We cannot accept responsibility for delays in thereturn of scheduled flights to the UK nor any resultant delays and costsfor your onward travel arrangements. Alterations to scheduled airlinedeparture times from the UK are also not our responsibility, nor are theresulting costs for altered travel arrangements to the airport nor anynecessary overnight accommodation or meal expenses.Tour members must have valid passports. In the unlikely event that atour member is refused a visa, or refused entry into a country, Jon Baines Tours Ltd will not accept any liability for any losses incurred andour normal scale of cancellation charges will apply. Cancellation willbe deemed to have occurred on the date on which we learn of therefusal of visa or permission to enter. Jon Baines Tours Ltd accepts no responsibility whatsoever for difficultiesarising from incorrect personal documentation, e.g. passports,inoculations. We cannot be liable for any medical expenses incurred by you or anyloss or additional costs incurred as a result of injury or sickness. You may be covered against such circumstances on your insurance policy.We cannot be held responsible for loss or damage to baggage,personal effects, money or documents.

6. Health

We issue advice on health and inoculations on our detailed predeparturenotes, which you will receive in good time before yourdeparture. We also strongly recommend that our clients consult theirGP for advice on immunisation.

7. Complaints

If you have any complaint about the tour arrangements you mustreport it to our local representative at the soonest opportunity, andsubsequently in writing to us within 30 days of your return. If youdo not give us such notice of complaint we cannot accept anyresponsibility for the matter. This agreement will be governed in all cases by the laws of England.

topp Protection

You are protected by Total Payment Protection Policy (topp) under policy no JBTL/topp/07/01. In the unlikely event of financial failure, subject to the terms and conditions of the Policy, customers' prepayments for non flight inclusive packages/flight inclusive packages will be reimbursed. Where return travel to the UK is included in the package purchased, customers will be repatriated to the UK. topp is underwritten by Travel & General Insurance Company plc, authorised and regulated by the Financial Services Authority.

Privacy

Jon Baines Tours collects two kinds of information from visitors to jonbainestours.co.uk: site usage information from server log files and email details when you contact an employee or division of Jon Baines Tours Ltd.

Server log files allow us to record visitors' use of the site. Jon Baines Tours may put together log file information from our visitors, which we may use to make changes to the site and to the information in it, based on the way that visitors interact with it. Log files do not contain any personal information.

When you click on a link to send an email to Jon Baines Tours some personal information such as your name, email address and telephone contact number will be passed on to us. This data is sent by our server as an email message and is not logged by any other system. We will never pass any of this data on to third parties.
